Proposed District Plan

The Proposed District Plan is now out for submissions between 13 December and 14 March 2014.

Leigh Robcke has summarised the changes from the Operative Plan, and I have repeated them here in full:

Changes being proposed

Some of the changes being proposed are:

• New legislative requirements have been incorporated from the New Zealand Coastal Policy Statement, the Hauraki Gulf Marine Park Act, the Proposed Waikato Regional Policy Statement and amendments to the Resource Management Act; 

• Objectives and policies have changed (Refer to policy and rules section in the Proposed plan) 

• The structure and layout of the Plan is different (Refer to Section 1 of the Propposed Plan - layout of the plan)  • Zones, rules and standards have changed; (Refer to the planning maps in the Proposed Plan) 

• Zoning of some properties is different to the Operative Plan; (refer to planning maps in the Proposed Plan) 

• Use of split zoning has been reduced. A site previously may have had two zones over eg coastal and rural. This site will now be zoned solely rural. 

• The number of site development plans and structure plans has been reduced; (refer too Part 5 of the Proposed Plan)

• Some designations from the Operative Plan have been modified, some have been brought over without change.

• Beach Amenity areas and rules may now apply to properties in this zone. For an eg look at Pauanui Beach here (refer too 29E Overlay in Proposed Plan)

• High voltage transmission lines are now shown as broken red lines on the planning maps. Rules managing activities near it are also shown on the planning maps. For an eg click here (refer to 36 Overlay Puriri in the Proposed Plan)

• There's new hazardous substances and contaminated land rules (refer to section 36 in Proposed Plan)

• Rezoning of Stage 1 of the Kopu-Thames Structure Plan, including introduction of 'Kaiwhenua'  (the severance land by the Kopu Bridge); (refer to structure plan part 5 in the Proposed Plan)

• Removal of the Coastal Zone and replacement with the Coastal Environment Overlay (refer to coastal environment overlay to  Section 7 of the Proposed Plan) and Rural Zone (refer to  rural zone to section 25 in the Proposed Plan)

Introduction of the Council's reviewed Code of Practice for Subdivision and Development

• New Historic Heritage areas and some Historic Heritage Items added and some removed. (refer to appendices 1 in Proposed Plan)

• Protection for new archaeological areas.  (refer to appendices 1 in the Proposed Plan)

• Inclusion of Māori cultural sites confirmed by the New Zealand Historic Places Trust. (refer to to appendices 1 in the Proposed Plan)

• Policy guide to settlement development and growth. (refer to section 15in the Proposed Plan)

• A new approach to managing biodiversity and indigenous vegetation. (refer to section 6 in the Proposed Plan)

• A revised schedule and rules for Significant Trees. (refer to appendix 3 in the Proposed Plan)

• New overlay rules addressing Landscape and Natural Character. (referto rules section 32 in the Proposed Plan)

• Natural hazards policy and rules for coastal erosion, flooding and tsunami.(referto section 10 in the Proposed Plan)

• Amended subdivision rules. (refer to rules section 38 in the Proposed Plan)

• New earthwork rules. Once you've established the zone you're in the earthworks rules are also included within that section.

• Rules enabling festivals and events in certain locations throughout the District. Once you've established what zone you're in the rules for enabling festivals and events are included within that section.

• Reframed rules relating to visitor accommodation, which includes holiday home rentals, home/farm stays and lodges. Once you've established what zone you're in the rules for visitor accommodation is included within that section.

• Papakainga development is enabled on Maori land i.e. land administered by the Maori land court) (refer to to section 33 in the Proposed Plan)

All land owners, (and others!) should take time over the holidays to see just what is being proposed - it is not revolutionary - more evolutionary, and most changes can be described as simplification, or common sense.

From where I stand, they seem to have got it right, and it is a credit to the Committee that worked it through. What needs to be watched is any attempt to relax controls even further - particularly related to sub-division. This is more likely if a laissez faire attitude becomes evident amongst the newly appointed Commissioners. Certainly Gaudie is expected to fit into this category, and as a Councillor, and local, is likely to exercise considerable influence during the Hearings process.
