Auckland Transport Corruption Sentencing

Here is the text of a question I submitted to TCDC this morning:

"Following on yesterday’s sentencing in the Auckland Transport fraud case, I note that the sentencing Judge made reference to the involvement of Optus and Hiway Stabilisers as having “lavished thousands of dollars on long lunches, electronics and international travel and accommodation on members of Noone & George’s team.”

I understand that our Council has had substantial contracts with one or both of these companies.

In view of this, and for no other reason, I would be interested to know whether or not our Council has a gifts policy in place that is policed.

If that is the case, can you please advise what is the limit of the value of gifts that any individual employee (or consultant) may receive without declaring same.

Secondly, have any gifts exceeding that figure been declared in the last twelve months, and from which source?

I don’t seek the names of those who may have received such gifts – I assume that they are properly policed.

Please note that this is no way a ‘witch-hunt’ - simply an attempt to gain assurance that the practices that evolved within Auckland Transport could not be repeated here.

I raise the issue because of the involvement of both organisations with Optus – now that they have been named in court, I believe that I am entitled to this information.

I received this reply promptly:

"No problems. We have a gift policy and register (along with a fraud policy and fraud officer) I'll get the details and send them through to you."

I will post the full response as soon as received.

Further response today:

"Attached is the gift register for the past 12 months along with our gift register policy.

The gift register is monitored by our Chief Financial Officer.

I hope that helps with your inquiry."

11.2 Receiving Gifts

11.2.1 Officers shall not accept any gift, service, or benefit under circumstances where the officer knows, or ought to know, that it could affect their present or future performance and position responsibilities.

11.2.2 Offers of gifts or benefits from contractors to staff should be declined unless an exceptional circumstance as deemed by the Group Manager, Chief Executive or Mayor to protect Council from risk including reputational.

11.2.3 Where an officer considers that it would be in the interest of the Council to accept a gift, favour, service or benefit, the offer shall be reported to the Group Manager at the earliest opportunity giving the source, a brief description, and estimated value.

11.2.4 Where any gift, service or benefit is reported, the Group Manager may:

a. decline to accept, or return, the gift;

b. accept it, providing it is made clear that no obligations are to be entered into whereby the giver expects an officer to take, or refrain from taking, any action that would tend to favour an interest; or

c. accept it and resolve how it is to be displayed, used or otherwise disposed of.

11.2.5 All gifts received are to be entered in a gifts register and remain the property of Council, except that gifts with a value less than $20 that are openly distributed by suppliers and clients (for example, pens, badges, calendars, chocolates) may be personally acquired by the officer.

That seems a pretty modest list and probably covers no more that the odd lunch or coffee etc. Three I could not get across from the list were Simon Berry - $10, Karl Baldwin - $25 and Glenn Brebner - $25.

Presuming this list is complete, then it represents excellent compliance by TCDC staff, but vigilance is the best policy, so do not hesitate to report incidents of gift giving that are 'out of the ordinary,' which come to your attention.
